This Privacy Policy applies solely to information collected by or in connection with the Services.

This policy does not apply to the practices of companies that Woofgenix does not administer or control, or to individuals who are not employees or agents of Woofgenix. Capitalized terms not defined in this Privacy Policy shall have the meanings assigned to them in the Terms of Service.

This information is voluntarily provided by you when registering or using the Services. Certain information, such as your email address, is required to register as a user of the Services. Your Rights and Choices

Right to Know and Data Portability

You have the right to request that we disclose certain information about our collection and use of your personal information over the past 12 months. This is referred to as the "right to know." Once we receive your request and verify your identity (see "Exercising Your Rights"), we will provide you with the following:

1.     The categories of personal information we collected about you.

2.     The categories of sources from which the personal information was collected.

3.     Our business or commercial purposes for collecting or selling that personal information.

4.     The categories of third parties with whom we shared that personal information.

5.     If applicable, two separate lists:

    • Sales: Identifying the categories of personal information that each category of recipient purchased.
    • Disclosures for a Business Purpose: Identifying the categories of personal information that each category of recipient obtained.

6.     The specific pieces of personal information we collected about you (this is called a "data portability request").

Right to Delete

You have the right to request that we delete any personal information we have collected from you and retained, subject to certain exceptions (referred to as the “right to delete”). Once we receive your request and verify your identity (see "Exercising Your Rights"), we will review your request and determine if any exceptions apply that allow us to retain the information.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete a transaction for which we collected the personal information, provide a good or service you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest, adhering to applicable ethics and privacy laws, when deletion may likely render impossible or seriously impair the research's achievement, provided you previously gave informed consent.
  • Enable solely internal uses reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information compatible with the context in which you provided it.

Additionally, anonymized or aggregated information derived from your samples or data that is used for algorithm training, research, or to improve our products and services is not considered personal information. As such, this information is exempt from deletion requests because it cannot be used to identify you personally and is critical for the continuous improvement of our Services.

If no exceptions apply, we will delete or deidentify your personal information from our records and will instruct our service providers to take similar action.

 

Exercising Your Rights to Know or Delete

To exercise your rights to know or delete as described above, you may submit a request by:

  • Emailing us at hello@woofgenix.com.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent, the authorized agent must first provide one of the following:

  • A signed letter from you authorizing the agent to submit a request on your behalf, or
  • A valid power of attorney.

The authorized agent must email one of these documents to hello@woofgenix.com and include a phone number where they may be reached during regular business hours.

You may also make a request to know or delete on behalf of your child by following this same process.

Frequency of Requests: You may only submit a request to know twice within a 12-month period.

Verification Process: To ensure the security and privacy of your information, your request to know or delete must:

  • Provide sufficient information for us to verify your identity or authority, which may include:
    • Full name
    • Phone number
    • Physical address
    • Email address
    • Date of birth
  • Include a detailed description of your request to enable us to properly understand, evaluate, and respond to it.

We cannot fulfill your request or provide you with personal information if we are unable to verify your identity or authority and confirm that the information relates to you.

Account Authentication: You do not need to create an account with us to submit a request to know or delete. However, requests submitted through your password-protected account will be considered sufficiently verified when they relate to personal information associated with that specific account.

Use of Request Information: Any personal information you provide for verification purposes will only be used to process your request or confirm your authority to make the request.

 

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within this timeframe, please contact hello@woofgenix.com.

We strive to respond substantively to a verifiable consumer request within forty-five (45) days of receipt. If we require more time (up to an additional 45 days), we will notify you of the reason and the extension period in writing.

  • If you have an account with us, we will deliver our written response through your account.
  • If you do not have an account with us, we will deliver our written response via mail or electronically, based on your preference.

Scope of Disclosures
Any disclosures we provide will cover only the 12-month period preceding our receipt of your request. In our response, we will explain any reasons we cannot comply with your request, if applicable. For data portability requests, we will provide your personal information in a readily usable format that allows you to transmit it from one entity to another without hindrance.

Fees
We do not charge a fee to process or respond to verifiable consumer requests unless the request is excessive, repetitive, or manifestly unfounded. Should we determine that a fee is warranted, we will inform you of the decision and provide a cost estimate before processing your request.

 

Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, you have the right to direct us not to sell your personal information at any time (the "right to opt-out"). Woofgenix does not knowingly sell the personal information of individuals under the age of 16. Consumers who previously opted in to personal information sales may opt out of future sales at any time.

To exercise your right to opt-out, you (or your authorized representative) may submit a request by emailing hello@woofgenix.com.

Once you make an opt-out request, we will honor it for a minimum of twelve (12) months before requesting that you reauthorize personal information sales.

You do not need to create an account with us to exercise your opt-out rights. Any personal information provided in an opt-out request will only be used to review and comply with the request.

 

Non-Discrimination

Woofgenix will not discriminate against you for exercising any of your rights under applicable data protection laws, including the CCPA. Specifically, unless otherwise permitted by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Information Security

Woofgenix is committed to protecting the security and privacy of your Personal Information. We implement commercially reasonable physical, electronic, and procedural safeguards to protect your Personal Information against loss, unauthorized access, use, modification, or deletion. However, no security system is foolproof, and we cannot guarantee the absolute security of your Personal Information or any other information you provide to us.

Children

Our Services are not intended for individuals under 18 years of age. If you become aware that your child has provided us with Personal Information without your consent, please contact us at hello@woofgenix.com. We do not knowingly collect Personal Information from children under the age of 13. If we learn that we have inadvertently collected Personal Information from a child under 13, we will take immediate steps to delete that information and terminate the account associated with it.

Sensitive Information

We ask that you refrain from sending or disclosing any sensitive Personal Information (e.g., social security numbers, financial account details, information about racial or ethnic origin, political opinions, religious beliefs, health, criminal background, or trade union membership) via our Site or Apps. Financial information should only be provided directly to our authorized third-party payment processor.
